Post subject:  Perry State Forest APV Area & CCW

Can a CHL carry concealed while riding an ATV in the Perry State Forest APV area?

Their posted regulations state: 11. Operators of APV’s shall not carry or transport any firearms
or other weapons that are not unloaded and securely encased.

Is this regulation overridden by Ohio CHL laws?

Just IMHO, the forest should be OK, but not any of their buildings. But to be honest, I have no idea.

Somebody will likely be along who knows, though.

Meantime, Welcome Aboard! There's a sticky at http://forums.buckeyefirearms.org/viewtopic.php?f=6&t=10097 that you might want to have a look at, but it's not mandatory, although slightly safer than an ATV :D....

Maybe. ORC 4519.40(A)(5)states:
Quote:
A) The applicable provisions of Chapters 4511. and 4549. of the Revised Code shall be applied to the operation of snowmobiles, off-highway motorcycles, and all-purpose vehicles, except that no snowmobile, off-highway motorcycle, or all-purpose vehicle shall be operated as follows:


(5) While transporting any firearm, bow, or other implement for hunting, that is not unloaded and securely encased;


This is an easily missed code section.

Now, the argument is that you are not transporting, but carrying. No caselaw on it yet to my knowledge.
