Buckeye Firearms SUES Cleveland today!

Buckeye Firearms Foundation, Inc., an Ohio not-for profit foundation, today filed a lawsuit in the Common Pleas Court of Cuyahoga County, Ohio seeking a temporary restraining order and permanent injunction to stop the City of Cleveland from prosecuting law-abiding gun owners under local ordinances that restrict gun ownership and concealed carry (CCW). The lawsuit also asks the Court to declare 20 different local ordinances unconstitutional on the grounds of state preemption of firearm laws.

So...how does the appeals court ruling today affect this lawsuit? Will it be put on hold until a Supreme Court ruling?

Not sure! Ken Hanson is deep into the middle of writing the amicus brief for the SCOTUS case, so we need to keep him focused. :lol:

We suspected all along that the Cleveland court was waiting on the ruling from this before they pursued our case.

Has anyone made the NRA and GOA aware of this and see if they wont get behind it??

No update to give yet. The Ohio Supreme Court hears Cleveland vs State of Ohio I think tomorrow. Until the results of that are made public, this one is stalemated.

Does the Ohio Supreme Court work fast?

I'm wondering about how the election will affect things. What happens if one of the judges who hears the case doesn't get re-elected? Do they have to rehear the case or will it be settled before the new court begins?

The decision could take months, PX4. I think the Ohio SC works somewhat like the national version--they start going through their docket this time of year, and finish up in the spring. Along the way they may issue some of their decisions, but save a bunch of them until they're about to vamoose over the summer.
