Nationwide Concealed Carry Reciprocity H.R. 38

H.R. 38 passed in the House of Representatives. Next stop, U.S. Senate where it's not necessarily a slam dunk. If it passes in the U.S. Senate and Trump signs it, you can bet with almost certainly that states attorney generals who oppose reciprocity will petition the SCOTUS to overturn it on grounds that it violates states' rights.

You can also be fairly certain that the minority Senate D will amend it into something that does not resemble what it is now. Perhaps in VERY bad ways. IMHO reciprocity should remain something negotiated between states...or established in state law. Keep the fed out of it.

I see a need for federal intervention because of states like Illinois, who has very stringent requirements that other states have to meet to secure reciprocity, or California, Hawaii, New Jersey, and Puerto Rico, where they turn down >99% of applicants for concealed carry permits/licenses under the guise of not meeting the "Justifiable Need" clause. Having a uniform federal law in place prevents states from arbitrarily issuing or denying permits and allows for consistency in application of laws across state borders. While we already have a law in place that protects the law abiding gun owner when the cross state boundaries with a firearm (the Firearm Owner Protection Act), this is an affirmative defense against formal accusation of having improperly carried a firearm, not a right. If we had national concealed carry reciprocity, there would be no question that an individual was properly carrying a firearm if they had a concealed carry permit/license.
