Prairie dog rules exceed federal powers

This is a case I have been watching for a while. It has some significant ramifications to the Commerce and Necessary and Proper Clauses as well as the Endangered Species Act.
In a ruling issued Tuesday, U.S District Judge Dee Benson struck down the regulations that prevent the capture, killing or “takes” of the Utah prairie dog.
Ruling that the federal government could not prove the animal “has a substantial effect on interstate commerce” Benson rejected the U.S. Fish and Wildlife’s argument for protecting the “threatened” rodent.
